Legal
Terms of
service
Last updated: October 25, 2026
These terms apply when you use aully.co or the Aully client portal, or buy a website, hosting, or support service from us. By buying a service or creating an account, you agree to them.
Who you’re agreeing with
Aully is a brand of Produktiv Agency Inc., a corporation incorporated in Ontario, Canada. Aully isn’t a separate company, so these terms are between you and Produktiv Agency Inc. operating as Aully (“Aully”, “we”, “us”). If you’re accepting on behalf of a business, you confirm you’re authorized to do so, and “you” means that business.
Our services
- Website builds: AI Websites and CMS Websites priced by page count, and Custom Websites quoted separately. Each package’s inclusions are described on our pricing page at the time you buy.
- Hosting plans: managed hosting for websites we build or support.
- Support plans: an ongoing request queue for content, design, and technical changes.
Custom work, and any proposal we send you, is governed by these terms plus the scope in that proposal. If they conflict, the proposal wins for that project.
Prices and payment
- All Aully services are billed by Produktiv Agency Inc. Your receipts, invoices, and card statements will show Produktiv rather than Aully.
- Prices are listed in US dollars and exclude applicable taxes unless stated. Payments are received by Produktiv Agency Inc. in Canada and may be converted to Canadian dollars. If your card uses another currency, your card issuer may apply its own exchange rate and fees.
- Website packages are paid in full at checkout. Project scheduling begins after payment is confirmed.
- Hosting and support plans are billed monthly in advance and renew automatically until cancelled.
- Payments are processed by Stripe and subject to Stripe’s terms.
Refunds
Website packages can be refunded in full until onboarding starts. Once work has begun, any refund is partial and based on the work completed. Hosting and support payments aren’t refunded for partial months; cancelling stops the next renewal. To request a refund, email hello@aully.co.
How projects work
- After payment, your client portal opens and you complete the onboarding briefs.
- Timelines depend on receiving complete answers, content, and feedback. If we’re waiting on you, the timeline moves accordingly.
- You review work and leave feedback in the portal. Approving a page or deliverable in the portal confirms it’s ready to move forward.
- Changes beyond the agreed scope may require a written change order, which can affect price and timing.
Your responsibilities
- Give us accurate information, and content you have the right to use. You’re responsible for reviewing the final content, including claims about your business, for accuracy and legal compliance.
- Keep your portal login secure and manage which team members have access.
- Don’t use our services, or websites we host, for anything illegal, infringing, harmful, or abusive.
Support plans
Your plan sets how many requests we actively work on at once. One active request is a clearly defined website task currently being worked on, and you can keep adding requests to your queue. Turnaround times on our pricing page are targets, not guarantees. You can change your plan as your needs change, or cancel before the next billing period; cancellation takes effect at the end of the current period.
Hosting
We aim to keep hosted websites fast, available, and backed up, but we don’t guarantee uninterrupted service. Hosting may be suspended for non-payment, for security reasons, or for misuse, and we’ll tell you when we can. If you leave, we’ll help you move your website to another provider.
How we use AI
We use AI tools, including ChatGPT (OpenAI) and Claude and Claude Code (Anthropic), to speed up imagery, code, and drafting, and our team directs, reviews, and tests the work. Our privacy policy explains what information these tools receive. AI-assisted output can contain errors, so please review content before you publish it.
Ownership
- Once the project balance is paid, you own the approved website deliverables we create for you.
- Third-party software and assets, such as CMS platforms, premium templates, plugins, fonts, and stock imagery, remain subject to their own licenses.
- We keep ownership of our own tools, processes, the client portal, and reusable components, and give you a license to use any that are part of your website.
- We only show your project in our portfolio or marketing with your consent, and you can withdraw that consent for future use at any time.
Confidentiality
We keep non-public information about your business confidential and use it only to provide our services. Please do the same with non-public information about Aully.
Limits on liability
Our services are provided as described, without other warranties to the extent the law allows. To the extent the law allows, we aren’t liable for indirect or consequential losses, such as lost profits or data, and our total liability for any claim is limited to the amount you paid us for the service concerned in the 12 months before the claim.
Ending the agreement
You can stop using our services at any time, subject to the payment terms above. We may suspend or end services if you seriously breach these terms or don’t pay. Sections that by their nature should continue, such as ownership, confidentiality, and limits on liability, survive.
Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Any dispute will be handled by the courts of Ontario.
Changes and contact
We may update these terms and will change the date at the top. Changes don’t affect work already paid for. Questions can be sent to hello@aully.co.
